By accessing or using our Services, you consent to the data practices described in this Privacy Policy. This policy applies to all clients, merchants, and users who subscribe to AiPSoft through our website or our Authorized Premium Partners.

2.1 Information You Provide to Us

To provide our Services, we collect information directly from you, which may include:

  • Account & Registration Data: Name, company name, email address, phone number, physical address, and billing information.
  • Business Data: Inventory, product catalogs, pricing, service workflows, and employee details entered into the system.
  • Customer Data: Information regarding your own customers (end-users) that you input into the POS or CRM, such as their names, contact details, transaction history, and preferences.
  • Support Data: Information you submit when contacting technical support or reporting issues.

2.2 Information Collected Automatically

When you use our cloud software or mobile applications, we may automatically collect:

  • Usage Data: Log files, IP addresses, browser types, operating systems, and timestamp data regarding your interaction with the software.
  • Device Information: Hardware models, unique device identifiers, and network information when using our POS terminals or mobile apps.
  • Cookies: Essential cookies are used to maintain your active session, remember your preferences, and ensure system security.

3. How We Use Your Information

We use the collected information strictly for business and operational purposes, including:

  • Providing Services: To operate, maintain, and deliver the cloud software, POS features, and mobile applications you have subscribed to.
  • Account Management: To process payments, manage billing, and maintain your subscription status.
  • Technical Support: To troubleshoot issues, resolve bugs, and provide remote or on-site technical assistance.
  • System Improvements: To monitor system performance, ensure server stability, and release software updates.
  • Communication: To send you essential administrative emails, system alerts, security notices, and approved marketing communications (which you may opt out of).

4. Data Sharing and Third-Party Integrations

We do not sell, rent, or lease your business data or your customers' data to any third party. We only share information in the following circumstances:

4.1 Approved Third-Party Service Providers

To provide contracted services, your data may be processed by trusted third parties integrated into our platform. This includes:

  • Cloud Infrastructure Providers: Secure hosting of our databases and cloud software (e.g., AWS).
  • Messaging Providers: Platforms like Meta (WhatsApp Business API), SMS gateways, and email service providers used to deliver notifications, invoices, and CRM campaigns.
  • Payment Gateways: Processors used to handle subscription payments or generate payment links for your customers.
  • Accounting & Tax Integrations: If you utilize integrations with FTA-approved platforms (e.g., Zoho, Wafeq, SAP), data is shared as configured by you.

Note: Data shared with third-party platforms (such as Meta) is subject to those providers' respective privacy policies and terms of service.

4.2 Authorized Premium Partners

If your account is managed, implemented, or supported by an Authorized Premium Partner (such as Tadkeer Information Solution), that partner will have access to your account and data strictly for the purposes of implementation, training, technical support, and billing.

4.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or UAE government regulations, or to protect the rights, property, or safety of AiPSoft, our users, or others.

5. Data Security and Confidentiality

We implement commercially reasonable technical and organizational measures to protect your data against unauthorized access, loss, destruction, or alteration. These measures include:

  • Data encryption during transmission (SSL/TLS).
  • Secure server hosting environments.
  • Role-based access controls within the software.
  • Regular security monitoring and backups.

Customer Responsibility: You are solely responsible for maintaining the confidentiality of your usernames, passwords, OTPs, and API keys. We are not liable for data breaches resulting from compromised customer credentials or improper user access management on your end.

6. Data Retention and Export

6.1 Active Subscriptions

We retain your business data for as long as your subscription remains active to provide uninterrupted service.

6.2 Upon Subscription Termination

If you choose not to renew your subscription:

  • You may request a standard data export within ten (10) calendar days of the subscription expiry, provided all outstanding invoices are settled.
  • Data will be provided in standard, software-supported export formats.
  • After the ten (10) day grace period, AiPSoft reserves the right to archive or permanently and irretrievably delete your data from our active servers in accordance with our data retention policy.

7. Artificial Intelligence (AI) Services

If your subscription utilizes our AI features (e.g., Voice-to-Order Assistants, automated messaging):

  • Data processed by AI models (such as transcripts or chat logs) is used strictly to execute the requested feature.
  • Depending on the specific configuration, AI processing may be handled by third-party LLM providers (e.g., OpenAI, Google, Anthropic). We do not permit these providers to use your private business data to train their public models.

8. Marketing Permission

As per our commercial terms, we may display your company name and logo on our website or marketing materials as a "Trusted Client" upon successful implementation. You have the right to opt out of this at any time by sending a written request to our support team.

9. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, or legal requirements. The updated version will be indicated by the "Last Updated" date at the top of this page. We encourage you to review this policy regularly.

10. Governing Law

This Privacy Policy is governed by the laws of the United Arab Emirates and complies with applicable UAE data protection and privacy regulations.
